Ministry of Commerce- Anti-dumping duties will continue to be imposed on imported hydriodic acid originating in the United States and Japan
On October 15, the Ministry of Commerce announced the final ruling on the anti-dumping measures applicable to imports of hydrogen iodide originating from the United States and Japan. According to the announcement, starting from October 16, 2024, anti-dumping duties will continue to be levied on these imports for a period of five years.
The announcement recalls that on October 15, 2018, the Ministry of Commerce released Document No. 80, which stated that anti-dumping duties would be applied to imports of hydrogen iodide from the United States and Japan, effective from October 16, 2018. The duty rates were set at 123.4% for U.S. companies and 41.1% for Japanese companies.
Following a request from China’s hydrogen iodide industry, the Ministry published Document No. 36 on October 15, 2023, which initiated a final review investigation into the anti-dumping measures for imports from the U.S. and Japan, effective October 16, 2023.
The Ministry concluded that if the anti-dumping measures were to be terminated, there would be a likelihood of continued or renewed dumping of hydrogen iodide from the U.S. and Japan, potentially causing further harm to China’s hydrogen iodide industry.
In light of the findings, and in accordance with Article 50 of the Anti-Dumping Regulations, the Ministry proposed the continuation of these measures to the Tariff Commission of the State Council, which made the decision based on this recommendation. Therefore, starting October 16, 2024, anti-dumping duties on imports of hydrogen iodide from the U.S. and Japan will remain in place for five more years.
The announcement also specified that, beginning October 16, 2024, importers of hydrogen iodide from these countries must pay the corresponding anti-dumping duties to the General Administration of Customs of the People’s Republic of China. These duties will be calculated based on the customs value, with the formula: anti-dumping duty amount = customs value x anti-dumping duty rate. Additionally, value-added tax at the import stage will be assessed based on the customs value plus any applicable duties and anti-dumping taxes.
